Jair Bolsonaro has been taken into custody after authorities concluded he posed a serious risk of fleeing while under home confinement.

The former head of state was found guilty of planning a military coup in September and given more than a 27-year term in prison, but he was staying under home detention pending court reviews.

High Court Judge Justice Moraes said the action to imprison the 70-year-old politician was a precautionary step after recent developments were revealed.

This encompassed attempting to break his electronic bracelet and a call for a public vigil that could "allow for a possible escape.

Legal Document Reveals Escape Concerns

In a filing authorising the detention, the judge said information from the unit overseeing his home detention suggested the ex-president's "intention to break the tracking monitor to ensure success in his flight.

This, it said, would be "facilitated by the confusion caused by the demonstration called by his child.

His child, his son Flávio, who works as a legislator, called for a meeting of his followers near Bolsonaro's home to take place on the weekend.

His son wrote on online platforms on last Friday: "Are you going to fight for your country, or see it all from your smartphone there on your settee? I call on you to battle with us."

He said the demonstration would be so followers could offer prayers for his health and for the reestablishment of democratic governance in our land."

Recent Legal Requests

It was only on Friday that the his legal team asked the Top Court to allow him to fulfill his full incarceration period under home confinement, with digital surveillance.

They also petitioned that he be authorized to depart his residence for medical care, saying he needed frequent medical attention for pulmonary infections and other ailments.

Background on Conviction

He was convicted of leading a scheme aimed at keeping him in power after he lost the 2022 election to his left-wing rival, Lula.

Supreme Court justices said that he knew of a plan which included plans to murder Lula and his running partner, his vice-presidential candidate, and to arrest and execute Alexandre de Moraes - the top judicial official who has been managing the former president's case.

The conspiracy was prevented because it failed to get the endorsement of the army and air force commanders. Lula was sworn in without problem on 1 January 2023.

But a following week, on January 8th, many his followers attacked and damaged public facilities in the federal district, the capital city.

The law enforcement took action and around fifteen hundred individuals were taken into custody.

The justices found that the protesters had been encouraged by the former president whose scheme, they said, was for the country's army to intervene, reestablish control and bring him back to power.

At the time, his attorneys called the 27 years and three months sentence unreasonably severe".

He was also prohibited from running for public office until 2060 - a decade minus two years after the conclusion of his imprisonment.

The ex-leader called the court case a targeted investigation" and said it was designed to prevent him running in the 2026 presidential election.
